Federal COVID-19 Vaccine Mandates: Employer Guide, Legal Updates, and State Specific Issues

On November 5th, we received OSHA guidance regarding the COVID-19 Emergency Temporary Standard (ETS) for vaccine mandates. The ETS applied to all employers that have a total of at least 100 employees at any time the ETS is in effect. Shortly after on November 6th, the three-judge panel of the Fifth Circuit issued a temporary stay (suspension) of the ETS and requested briefing from OSHA.

The Departments of Justice and Labor have announced their intention to fight in court for the implementation of the OSHA ETS. And the federal government has expressed confidence in its legal authority to issue the ETS.
