Duty To Assist Error? NOPE! - Higher Level Review, Done Improperly

Published
This video will teach you what a duty to assist error is and I will give an example. As required by law, the VA has an obligation to assist veterans with their VA claims, known as the Duty to Assist.

Each year, tens of thousands of claims are remanded back to VA Regional Offices because of duty to assist errors, and this number is increasing because the Higher Level Review process has put this on overdrive.

A higher-level review option allows veterans to request that another VA employee go through the review process again if they feel the original reviewer made a mistake.
