Can your employer fire you for filing a workers’ compensation claim?

North Carolina is a “right to work” state, employers may not retaliate against employees who either file a claim, initiate any inquiry, investigation, inspection, proceeding or other action, or testify or provide information to any person with respect to a WC claim.

North Carolina does this through a law called the North Carolina Retaliatory Employment Discrimination Act or REDA for short. And what I just listed off for you is directly from the REDA statute. REDA protects a worker from retaliatory or discriminatory employment action such as termination, suspension, demotion, a reduction in wages, or even being relocated as retaliation for pursuing rights under the WC Act. As an aside, REDA also protects a worker who reports workplace violations or provides information regarding violations.
