CAN I BE FIRED OR DEMOTED FOR BRINGING WORKERS' COMP CLAIM?

People who get injured at work are often afraid to file workers’ compensation claims for fear that their employer will retaliate against them by firing them or demoting them. The good news is Nevada law prohibits employers from retaliating against employees merely for filing a workers’ compensation claim. However, Nevada is an at-will employment state, and employers may still try to find other reasons to fire or demote these employees.

We typically see this scenario when employers give injured employees temporary, light-duty work. Oftentimes this light-duty work falls outside of the employee’s skill set, or the physical demands are still too taxing. So if the injured employee does a subpar job – or calls in sick too often – the employer can then fire them for incompetence or misconduct even if the employer’s true motive for the firing was retaliatory.

If an employee may have been fired or demoted for filing a worker’s compensation claim, that employee can take legal action against the employer by filing a complaint with the Nevada Equal Rights Commission or by filing a lawsuit. Depending on the case, the employee may be able to get job reinstatement, a financial settlement, or both.
