Can Brian Flores's lawsuit against the NFL and three teams survive? TWO EMPLOYMENT LAWYERS WEIGH IN!

Published
On February 1, 2022, the first day of Black History Month, Brian Flores filed a bombshell class-action lawsuit in federal court. Mr. Flores, the former head coach of the Miami Dolphins, claims that the Dolphins, New York Giants, and Denver Broncos discriminated against him based on his race. He further alleges that the National Football League and its 32 teams have systemically undermined the hiring and retention of Black head coaches, coordinators, and general managers.

You can read a copy of Mr. Flores's complaint here: https://www.wigdorlaw.com/wp-content/uploads/2022/02/Complaint-against-National-Football-League-et-al-Filed.pdf

In this video, my FisherBroyles employment law partner, Amy Epstein Gluck, discusses the merits of Mr. Flores's complaint with me.

This isn't about whether Mr. Flores will prevail. We have no idea. Rather, we focus on whether there are enough facts pled in the complaint to survive an early legal challenge from the defendants (i.e., a motion to dismiss).
