Under federal marijuana prohibition, workers in the cannabis industry have not been covered under the National Labor Relations Act (NLRA) or the Fair Labor Standards Act (FLSA), and may not be even if marijuana is removed from the Controlled Substances Act. Likewise, employees in non-cannabis industry jobs can be at-risk to lose their jobs for using marijuana off-the-clock in legal jurisdictions, even when they are medical marijuana patients or when their use of marijuana on their own time has not been shown to impair their job performance. Without adequate provisions, employees in the US could continue to be at-risk of losing their jobs for legal use of marijuana or participating in the cannabis industry. This panel of the MJC Senate briefing series discusses how the federal government should tackle these important issues.
