2022 Supreme Court Preview: The Courts and the Limits of the Administrative State

Saturday, September 17. This Court does not seem shy about limiting the power of administrative agencies, including limits on agency authority and agency structure, all in the name of preserving separation of powers. This panel will discuss what comes next: pending appointments challenges to the FTC and SEC, the major questions doctrine, and in general the broad direction of the Court’s limitations on the administrative state.
