Temporary workers are employed for a period lasting from a few days to several months. Temporary workers replace full-time employees on leave or provide services as seasonal workers during holidays or other periods of high demand.

While temporary workers may be considered non-employees or independent contractors, businesses must still accord such workers certain rights relating to wages and salaries, health and safety and protections against discrimination and harassment. These laws are also applicable to non-immigrant workers. Temporary workers are protected by federal law from discrimination based on race, national origin, gender or disability. This means that a temporary worker who is a female must be paid the same wages as another male employee who performs the same job.

In addition, a temporary employee who has the requisite work permit cannot be denied work because she comes from a foreign country. Temporary workers are protected against sexual harassment from the business owners and employees where they work.

Sexual harassment is inappropriate touching in a sexual manner, use of sexually-explicit language and demands to perform sexual acts. Temporary workers can use the same complaint processes as employees to report harassment and, if employed by a temporary agency, may also complain to the agency.

Businesses must maintain a safe and healthy environment for temporary workers. Workers in settings where housing is provided by the employer have the right to a safe, clean and habitable living space. Bathrooms in the workplace must be sanitary and potable water should be available for temporary agricultural workers. All temporary workers have the right to be paid fair wages for the work performed. Temporary workers are subject to the minimum wage laws and cannot be paid less than that amount.

Most workers are also entitled to pay at one-and-a-half times their regular earnings if they work over 40 hours per week. Non-immigrants coming to the United States to work temporarily under special visa provisions are also afforded certain rights in the workplace.

An employer may not hold the passport of the foreign temporary worker, but must permit the worker to have possession of all documentation, including the passport and visa. The foreign temporary worker may not be subjected to forced labor and cannot be threatened to be turned over to immigration officials by the employer.

The Ontario government is set to bring in the province's strictest-ever rules for companies that recruit temporary workers, including a system for shutting down temp agencies that exploit staff, CBC News has learned. A recent case highlights why employers who use agency workers should check the terms of their contracts of employment. Mr Kocur was employed by Angard Staffing Solutions, an agency supplying temporary workers and, through the agency, he worked for the Royal Mail. Mr Kocur was given one hour rest breaks, but was only paid for 30 minutes while Royal Mail employees were entitled to one hour paid rest breaks.
