Employer right to not recognise the union

The micro- and macroeconomic effects of the declining power of trade unions have been hotly debated by economists and policymakers, although the empirical evidence does little to suggest that the impact of union decline on economic aggregates and firm performance is an overwhelming cause for concern. That said, the association of declining union power with rising earnings inequality and the loss of an important source of dialogue between workers and their firms have proven more worrisome if no less contentious. Trade unions under certain bargaining structures can have favorable macro consequences by being less aggressive in their wage bargaining. Trade unions can have favorable micro outcomes by stimulating worker voice. Where there are benefits to a long-term relationship between the employer and the worker, trade unions can facilitate contracting.

A labor union is an organization that acts as an intermediary between its members and the business that employs them. The main purpose of labor unions is to give workers the power to negotiate for more favorable working conditions and other benefits through collective bargaining.

Collective Bargaining Collective bargaining is the heart and soul of the labor union. Collective bargaining occurs when a group of people, such as the workforce at a company, bands together to increase its negotiating power. For instance, a single worker might feel that a certain new safety measure should be implemented in his factory, but he might have limited power to get the company to install the new measure.

If the entire workforce is made aware of the need for the new measure and bands together to pressure the company to install it, there is a much greater chance that the company will comply. Labor unions join workers together, allowing the voices of individual workers to be heard and made into a goal of the whole union. Workplace Safety When labor costs more, employers invest more in training and equipment, which improves workplace morale and boosts productivity.

When workers are taken care of, everyone benefits. The antagonism between business and organized labor is not inevitable. But when employees are considered disposable, businesses can become less interested in protecting them. Employees also may lack someone to intervene on their behalf with management on safety issues when there is no union representation.

When workplaces become organized, the need for cooperation becomes more obvious. Companies recognize that they can take steps to make a stable workforce more safe, productive and effective, through training, better equipment, and making better use of their knowledge.

Unions, in turn, increasingly recognize the needs of employers to be responsive to customers and competitive in their markets. In some sectors, having a company story that involves union workers and living wages may be a competitive advantage commercially. Higher Wages One of the top benefits of being a union worker is that you enjoy a better wage as compared to your non-union counterparts. Union workers are also more likely to enjoy consistent pay raises on a regular basis.

This is due to collective bargaining between the union on behalf of the employees and the employer that results in an agreement setting out clear terms regarding pay and wages. With a non-union job, the employer can set the wage without any formal bargaining process or input from the employee.

Better Benefits On average, union workers are more likely to enjoy better benefits compared to non-union employees.

That includes health, retirement accounts, and paid sick leave. According to a report by the U. Bureau of Labor Statistics, pension coverage for unionized workers is significantly higher than for non-union workers: in the public sector 78 percent of union workers have pensions 67 percent in the private sector , in contrast to a mere 13 percent of non-union workers in the private sector.

Again, union representatives work out these details as a part of the collective bargaining agreement with the employer. Your Representative One other key benefit of working as a union employee is that union representatives work on your behalf if you have a personal issue with the employer. Having a union representative evens out that balance of power. Toggle navigation. Home Our People National President.

Workers reported intimidation, threats and discrimination, but stood firm. Now, nearly half of the garment factory workers are members of the trade union. According to Sri Lankan labour laws, this means that Next, as an employer, should accept the trade union as representative of its workers and engage in negotiations with them. Three months down the line and Next has still not done this. This is not a decision for the company to make, as workers decided what was in their best interests when they joined a trade union of their choice. Next cannot insist that the union can only meet with the JCC. As nearly half of the workforce has formed a trade union, which is an organisation of workers as defined by the ILO Conventions 87 and 98, Next cannot continue to justify refusing bilateral meetings with the union. Yet branch leaders and managers working in the Sri Lankan factory, and Next managers from outside Sri Lanka, already use remote video conferencing for other meetings.

You have a legal right to be accompanied to a grievance meeting about your employer's failure to meet its obligations to you, either by a fellow worker or by a trade union official. You have the right to be accompanied by a trade union official even if your employer doesn't recognise trade unions although your union is not under a duty to provide someone to accompany you. If you are to be accompanied by a trade union official, the official must be trained and certified by the union to act as a worker's companion. Check your contract of employment , as this may specify a broader range of people who can accompany you.

Workers' rights

The National Labor Relations Act forbids employers from interfering with, restraining, or coercing employees in the exercise of rights relating to organizing, forming, joining or assisting a labor organization for collective bargaining purposes, or from working together to improve terms and conditions of employment, or refraining from any such activity. Similarly, labor organizations may not restrain or coerce employees in the exercise of these rights. After employees choose a union as a bargaining representative, the employer and union are required to meet at reasonable times to bargain in good faith about wages, hours, vacation time, insurance, safety practices and other mandatory subjects. Some managerial decisions such as subcontracting, relocation, and other operational changes may not be mandatory subjects of bargaining, but the employer must bargain about the decision's effects on unit employees. It is an unfair labor practice for either party to refuse to bargain collectively with the other, but parties are not compelled to reach agreement or make concessions.

Amazon workers in the UK and Ireland should be allowed to talk with and form unions "without fear", the Unite union says. It said the shopping giant, which has faced allegations of poor working conditions, often tried to suppress union organising at its warehouses. No UK Amazon warehouses are unionised, but by law, workers could set one up. Amazon said it respected its employees' right to "join, form or not to join a labour union" of their choice. Unite's call comes after workers in Alabama in the US voted against forming that country's first unionised Amazon warehouse. Amazon - which would have had to negotiate on work rules and pay, had it lost - said the union did not represent the views of most staff.
